TERMS AND CONDITIONS

1. Driving License Submission:
   Customer shall require submitting the original driving license while you pick the motorbike. These documents will be returned after returning the bike in good condition. For international visitors, a valid driving license from their home country with International Driving Permit is necessary along with a valid Visa. Original to be brought; copy will be retained for record.

2. Helmet:
   We shall provide you with a Helmet. You need to return it back without any damages. In case of any damage caused, the customer/Hirer shall bear the damage cost. Further, the customer is responsible for their own safety and bike.

3. Cancellation Policy:

   • If you intend to cancel your booking with 5Speed, the refund will be made according to the 5Speed refunding schedule:
     • Less than 36 hours – No refund will be made.
     • More than 36 hours – 80% refund is applicable.
     • More than 48 hours – 100% refund.

   • If your booking is cancelled due to the bike’s breakdown or non-availability of the bike or for any other reason, then we provide 100% refund.

   • Cancellation after the pickup time: no refund.

   • 100% deduction and only the security deposit will be refunded.

   • Refund of the caution deposit for the 5Speed bike rental transaction of offline booking will be credited to your account before 3 working days.

4. Late Return:
   Penalty for late return of bikes is applicable. All bikes taken on rent are to be returned back at the destined time and date, as agreed in the booking form. In case you are going to be late, you can extend your reservation time and date to avoid penalty. At times we may not be in a situation to extend, since there would be another confirmed reservation for that period. Hence, you need to pay a penalty of 2 days along with 5Speed Late Charges.

5. Accident Liability:
   If you have met with an accident while riding, due to being drunk or under the influence of any drugs, there would not be any liability under insurance coverage. Hirer must have coverage through such accident and liability insurance. 5Speed will not be responsible for accidents or damages caused under any circumstances. Any damage caused to the vehicle will be completely borne by the Hirer/Rider. Company shall not be responsible for any death to Hirer/Rider/Pillion Rider due to accident and/or any third party death or damaged caused.

6. Damage:
   Any damage caused to the vehicle will be completely borne by the Hirer/Rider. Company shall not be responsible for any death to Hirer/Rider/Pillion Rider due to accident and/or any third party death or damaged caused.

7. Gear Damage:
   If Motorbike or gear is damaged during the ride, check and assure the delivery of the bike in appropriate condition. You are responsible for any damages that occur to the lost gear or motorbike.

8. Repair Charges:
   Repair charges will be deducted from the deposit and also a period rental will be collected. If in case the bike is damaged and the complaint has been logged after a few days of its return, the Hirer will still be held responsible. The Hirer should verify the condition of the bike before hiring and is satisfied with the condition of the vehicle. The Hirer shall not hold 5Speed or any other person associated, responsible for any loss of life or property due to the condition of the vehicle.

9. Speed Limit:
   Customer should not drive beyond the speed limit of 90 km/h for Royal Enfield and 60 km/h for scooters. If the customer exceeds the maximum speed limit, the customer will be liable to pay a fine of ₹500 on every limit breach.

10. Loss of Vehicle:
    In case vehicle is lost, 5Speed or the Customer is responsible for that. Customer needs to report this immediately, we will try to locate the vehicle with the tracking system.
    (A) If the customer fails to report the theft, he/she shall pay the company a penalty.
    (B) In the absence of tracking devices, the customer is responsible for the total cost of the bike.
    (C) In case the customer loses the vehicle during your trip, they have to immediately inform the local authorities as well as 5Speed Ltd without any delay. An FIR shall be filed with the local Police Station. 5Speed shall provide all necessary assistance and the Hirer shall provide complete co-operation to fulfill the formalities.

11. Accident or Breakdown:
    All accidents, damages to the vehicle, summons or notices issued by the police or any court in relation to acts while the vehicle was under the custody of the Hirer shall be intimated within one hour of such incident to support@5Speedmotor.com.
    The Hirer shall also report in writing, the entire events in minutes detail regarding the accident.
    Any misstatement or concealment is an offense. 5Speed shall not protect the Hirer with its insurance if the Hirer doesn’t follow the above instructions.
    In case of accidents/breakdowns, the vehicle cost of towing from the place of accident to the service station and all other amounts that are not approved by insurance company, which includes damage to the property of third party and their party have to be paid by the Hirer.

12. Compliance:
    The vehicle shall be used fully complying with Motor Vehicle laws, rules, notifications, and other general laws. If you violate any form of traffic rules or regulations, then you will be held wholly responsible for the penalty and fine, which we will be charging post handing over the bike to us. And 5Speed does not pay such expenditures on behalf of you.

13. Electronic Devices:
    Riding while using electronic gadgets like radio/music, video, camera, or phone by rider is prohibited.

14. Luggage Use:
    The bike shall not be used for transportation of goods and should not carry any luggage more than what is stipulated under any provisions of law.

15. Repairs and Fittings:
    You are not allowed to do any repairs or external fittings of the vehicle.

16. Crossing State Border:
    The rider has to inform 5Speed in advance whenever he is intending to go to other states. The rider has to ensure that he takes the necessary approval at the check post and pays the permit fee before he enters the other state. 5Speed will not be responsible for any damage to life and property if the necessary permits are not taken while entering another state.
    5Speed Insurance will also not be valid if the necessary permits are not taken by the rider while crossing the border.

17. Drunk Driving:
    All the booking will be cancelled if the customer is found drunk during pickup of the vehicle and no refund shall be provided.

18. Handover Policy:
    The vehicle is handed over to the same person as per our online booking and document details.

19. Responsibility:
    5Speed is not responsible for any death to Hirer/Rider/Pillion Rider during rental tenure. Any damages cost to the vehicle during customer rental, customer shall bear all the expenses as per the costing of the showroom.

20. Support:
    If you face a breakdown or any trouble, you can give us a call and we will give you support through our mechanic network channel. We will assure that the bikes are repaired immediately and given back at their earliest depending on the situation and type of Mechanical Failure.

NOTE: FUEL IS EXCLUDED

The above Terms and Conditions shall be governed by the laws of India. All disputes, claims, and actions arising out of this Terms and Conditions will be subjected exclusively to the jurisdiction of the competent courts at Bangalore, Karnataka, India.
